The short version
AT A GLANCE- Request a full refund within 14 calendar days of a payment, including renewals. See refund policy.
- Cancel any time on your Account page. You keep your plan until the month you paid for ends.
- Under 18? You need a parent or guardian's permission to sign up, and they must make or approve any payment.
- You're responsible for what you publish, including any domain you connect and the messages your site's forms collect.
- No harassment, hacking or unlawful activity. Suspected offences may be reported to the relevant authorities.
- Malaysian law governs these Terms. Your mandatory consumer rights remain protected.
This summary helps you find your way around. The full terms below are what apply, subject to mandatory law.
01. Who operates the service
Destiny is operated by [LEGAL NAME OF OPERATOR], [REGISTRATION NUMBER IF APPLICABLE], at [BUSINESS ADDRESS], Malaysia. In these Terms, “we”, “us” and “our” mean that operator. “You” means the person using the service or, where applicable, the organisation they are authorised to represent.
Website [WEBSITE URL]. Support, refunds, security and copyright reports [CONTACT EMAIL]. You can also reach us on WhatsApp through the Contact link. Contact telephone [PHONE NUMBER].
02. Agreement and account eligibility
Please read these Terms before registering or purchasing. By ticking the agreement box when you sign up, you accept these Terms. If you do not agree, do not create an account or purchase a service. The Privacy Notice explains how personal data is handled.
When you sign up, you tell us whether you are 18 or older. If you are under 18, you may only create an account with the permission of a parent or guardian, who confirms that permission by ticking the parental consent box and who accepts these Terms on your behalf. A paid plan for an under 18 account must be bought or approved by that parent or guardian. If we learn that an under 18 account was created without that permission, we may close it.
Your account is created only after you confirm your email address with the code we send you. You log in with your full name, email address and password, so your full name must not already be used by another Destiny account. Provide accurate account and billing details, keep your password private and tell us promptly about suspected unauthorised access. Resetting your password logs out your other devices.
Do not share your login. An Ultimate plan may be shared with other accounts only as described in clause 16. You are responsible for use you authorise, but you are not automatically liable for activity caused by our security failures.
03. What the service provides
Destiny uses artificial intelligence to create a website from your description, business details and uploaded photos. You can preview it on desktop, tablet and phone sizes, change it by asking the AI, edit its text yourself, go back to earlier versions, download it and publish it online (see clause 17). Paid plans can also create sites with several pages. If you give a WhatsApp number, the site can include a button that opens a WhatsApp chat with that number.
Each plan has a daily number of websites you can create, shown on the Services page and in the studio. The count resets at midnight Malaysia time. If the AI fails to create a website, that attempt is not counted. Editing text yourself does not count. On the Ultimate plan, the first 15 websites each calendar month (counted together for the owner and the accounts they share it with) are made with our most advanced AI model; after that, websites are made with the model used for the Legendary plan until the 1st of the next month. The studio shows how many are left. Each plan also limits how many sites you can publish at once and how much you can upload: the Free plan allows photos only, and paid plans also allow videos.
Paid plans may use more capable AI models than the Free plan. The models we use may change over time, but we will not reduce the features of a plan you have already paid for during that paid month.
When a new website has fewer than 3 of your own photos, Destiny may add free stock photos from Unsplash or Pexels that suit your request, with credit to the photographers. A purchase covers the features offered at that time. Features described as planned or coming soon are not included unless the purchase description promises them. Free access does not itself create a paid subscription.
04. Acceptable use and prohibited conduct
You must not use the service, prompts, uploads, generated content, published sites or their contact forms to commit, promote or assist unlawful conduct. Prohibited conduct includes sexual harassment, threats, stalking, sexual exploitation, non consensual intimate material, child sexual abuse material, fraud, scams, phishing, impersonation, theft of personal information and infringement of intellectual property rights.
You must not request or publish content or websites designed to sexually harass, exploit or threaten another person, facilitate a crime, steal credentials, collect payment details under false pretences, pretend to be another business or person, or distribute malware. Lawful educational discussion, prevention information and good faith reporting of abuse are not prohibited merely because they mention a crime or sexual harassment.
Do not hack or attempt unauthorised access to accounts, servers, databases or administration systems; bypass payment, authentication or usage limits; intercept credentials; alter or delete data without authority; run denial of service attacks; send spam through published site forms; or introduce malicious code. Do not conduct intrusive security testing without our prior written permission. Report accidentally discovered vulnerabilities privately to [CONTACT EMAIL] and stop accessing affected data.
05. Reports and legal action
We may refuse requests, restrict access, take published sites offline, remove unlawful material and preserve relevant evidence where lawful and necessary. Anyone can report a published Destiny site to [CONTACT EMAIL]. Suspected sexual harassment, hacking, attempted unauthorised access or other unlawful conduct may be reported to the Royal Malaysia Police or another competent authority. We may seek civil remedies in Malaysian courts with jurisdiction.
Where proceedings are brought, the competent court or tribunal decides liability and remedies. Criminal investigation and prosecution are matters for the relevant authorities; these Terms do not guarantee prosecution, conviction or a particular penalty. Any disclosure of personal data must have a lawful basis and comply with applicable law.
06. Your content and our materials
You retain rights you already hold in your prompts, business details, uploads and other submitted content. You must have the rights and permissions needed for us to process it, including the right to use any photos, logos and text you upload. Do not submit another person’s confidential information or personal data without a lawful basis.
You give us a limited, non exclusive permission to store, process and display your submitted content only as needed to supply the requested service, provide support, secure the service and comply with law, as described in our Privacy Notice. This includes sending your request, business details and uploads to our AI provider to create your website, and giving uploaded photos a web address so they can appear on your site. When you publish a site, it and its photos are shown publicly to anyone who visits it.
We may show a published site in the “Made with Destiny” gallery on our homepage only with your permission, and we will remove it whenever you ask. Your permission does not authorise any other advertising use or training AI models on your content.
Our service software, branding and original materials remain owned by us or our licensors. We permit you to use the service within your plan. You must not resell our service, remove required rights notices or redistribute our protected materials without permission or another lawful basis.
07. Generated websites and your responsibilities
AI generated websites may contain mistakes, wrong details, inaccessible layouts, missing functionality or material that resembles third party work. Where you have not given a detail, such as a price or address, the website may show a placeholder in square brackets for you to fill in. Check every fact, price, contact detail and claim before you publish or share the site.
As between you and us, we assign to you any rights we hold in output generated specifically for you, to the extent those rights can lawfully be assigned. This does not transfer our underlying service software or third party materials. We do not promise that output is unique, copyright protected or free from third party claims.
Stock photos added by Destiny come from Unsplash or Pexels under their own licences. They may be used on your website, but you must keep the photographer credit, must not sell the photos on their own and must not suggest that the people or brands shown endorse your business.
You are responsible for your website’s content and for the policies and permissions your business needs, such as a privacy notice if you collect personal data. We do not guarantee search rankings, sales, browser compatibility in every environment or an error free result. These limits do not remove our obligation to provide the paid service as promised or any rights preserved by clause 11.
08. Prices, subscriptions and cancellation
Paid plans (Mini, Pro, Legendary and Ultimate) are monthly subscriptions paid through PayPal. Before payment, the Services page and PayPal checkout show the price, currency, included features and that billing repeats every month. Only the payment schedule you approve in PayPal applies. Your subscription renews each month until cancelled.
We may change our plan prices in the future. A new price applies only to subscriptions started after the change. If you already have a subscription, you keep the price you signed up at for as long as it stays active, and we will not raise it without first telling you by email and asking for your agreement in PayPal; if you do not agree, you can cancel and keep your plan until the end of the month you have paid for. If you cancel and subscribe again later, the price at that time applies.
After you pay, we email you a 13 digit code. Your plan starts once you enter it. If the code is not entered within one day, we cancel that subscription so you are not charged again, and you may request a refund of the first payment under clause 9.
If you move to a different paid plan, the new plan starts once confirmed and we cancel your old subscription so you are not billed twice. The new plan’s monthly price applies from that day. We do not automatically credit unused days of the old plan, but you may request a refund of a payment made in the last 14 days under clause 9.
Cancel any time with the Cancel subscription button on your Account page, by cancelling in PayPal, or by emailing [CONTACT EMAIL] from your account email. Cancellation stops future payments, and you keep your plan until the end of the month you paid for. Deleting your account also stops future billing.
If a monthly payment fails, you keep your plan for a 7 day grace period. If the payment still has not arrived after that, your account moves to the Free plan. Your websites and published sites stay, but Free plan limits then apply.
We will notify you of any price increase at least 30 days before it takes effect and allow cancellation. Increases do not apply to a period you have already paid for. PayPal’s own terms also apply to your payment; this does not remove our responsibility for the service we sell to you.
09. Fourteen day refund policy
You may request a full refund of a payment made to us for this service within 14 calendar days after that payment, including a first payment or a monthly renewal. The deadline is 11:59 pm Malaysia time on the 14th calendar day after the payment date. Using the service during this period does not by itself remove your eligibility. No explanation of dissatisfaction is required.
Email [CONTACT EMAIL] with your account email, payment date and PayPal transaction reference. We may request reasonable information to verify the payment, but never your password or full card details. A request received within the deadline remains timely while verification is completed.
We will issue an eligible refund through PayPal to the original payment method within 14 calendar days after receiving the information reasonably needed to verify it, or sooner where required by law. Your bank or PayPal may take additional time to show it. If the original method cannot receive a refund, we will agree a suitable alternative. We do not deduct our processing fees.
When a full refund is issued, that subscription is cancelled and your paid plan ends straight away; your account moves to the Free plan. If you share an Ultimate plan, the people you added lose it too. Outside this 14 day window, change of mind refunds are not normally offered. Statutory remedies for a defective, misdescribed or undelivered service, and rights concerning unauthorised or duplicate charges, remain available where applicable. No duplicate refund is payable for the same payment.
10. Availability and limits of responsibility
We will use reasonable care and skill in providing the service, including hosting published sites. Maintenance, outages and failures of services we rely on (such as our AI provider, PayPal or email provider) may interrupt access. We do not promise continuous availability or that every error can be prevented. Keep your own copy of websites you need, for example with the Download button.
To the extent permitted by law, Destiny is not responsible for problems caused by your changes to generated code, the content you publish, your domain or DNS settings, misuse, or external services outside our reasonable control, except to the extent our own breach or fault contributed. Website generation limitations are described in clause 7.
We do not guarantee business profits, savings or particular results. Any exclusion applies only where lawful and fair; it does not excuse failure to deliver the paid service as promised. We do not impose a blanket exclusion of responsibility for all website or service problems.
11. Rights that these Terms do not remove
Nothing in these Terms excludes or restricts consumer guarantees, statutory remedies, or any duty or liability that cannot lawfully be excluded or restricted. Nothing excludes liability for our fraud or wilful misconduct. If a limitation conflicts with mandatory law, that law prevails. This clause applies to every part of these Terms, including refunds, service limitations and dispute procedures.
12. Suspension and ending access
We may restrict or suspend access, or take a published site offline, where reasonably necessary to address a serious breach, a credible security threat, unlawful activity or non payment. Where appropriate, we will explain the reason and allow you to respond or correct the issue. Immediate action may be necessary to protect people or systems or comply with law.
You may delete your account at any time on your Account page by entering your password. This stops future PayPal billing and permanently deletes your websites and their history, your published sites (which go offline), connected domains, business details and uploaded files. Download anything you want to keep first. Deletion cannot be undone.
You may challenge an account decision at [CONTACT EMAIL]. Suspension does not automatically forfeit an eligible refund or statutory remedy. If we permanently discontinue a paid service without a breach by you, we will refund the unused prepaid portion. Where reasonably practicable, we will provide notice and an opportunity to download your websites.
13. Privacy and external services
Our Privacy Notice explains the personal data collected, purposes, service providers, retention and available privacy rights. These Terms are not a substitute for that notice or for consent where separately required.
To run Destiny we use these service providers: OpenAI, to create websites from your requests, business details and uploads (including still frames and spoken words from uploaded videos); PayPal, for payments; Brevo, to send code emails and contact form messages; Unsplash and Pexels, to search for stock photos using words from your request; and Cloudflare’s public DNS service, to check the records of a domain you connect. Each has its own terms and privacy practices. We remain responsible for obligations the law places on us when we choose or use service providers.
Destiny uses a login cookie on our own website so you stay signed in and to protect your forms from misuse. Published sites do not get a Destiny cookie. The visitor numbers we show site owners are counted without cookies, and we do not store visitors’ IP addresses for this.
14. Malaysian law and dispute resolution
Malaysian law governs these Terms, subject to any mandatory consumer protections that apply to you. Contact [CONTACT EMAIL] about complaints so we can try to resolve them. Contacting us first is encouraged but is not a condition that prevents you from exercising a legal right or meeting a legal deadline.
Subject to mandatory law, disputes arising from these Terms are to be resolved by Malaysian courts with jurisdiction. This does not exclude the Tribunal for Consumer Claims Malaysia or another competent tribunal where legally available, prevent reports to authorities, or override criminal jurisdiction. Allegations of hacking and other unlawful conduct may be referred to authorities and pursued as described in clause 5.
15. Changes and general terms
We will publish updated Terms with a new effective date and give reasonable advance notice of material changes. Changes will not retrospectively remove accrued rights, refund eligibility or purchased benefits. Where a change requires your agreement, we will obtain it. You may cancel future renewals before revised terms take effect.
If a provision is unlawful or unenforceable, it applies only to the extent lawful or is severed, while the remaining Terms continue where possible. Failure to enforce a provision once does not waive the right to enforce it later. These Terms and the specific terms shown and accepted at checkout govern the service, subject always to mandatory law.
16. Sharing an Ultimate plan
If you pay for the Ultimate plan, you may share it with up to 2 other Destiny accounts. Each person needs their own account with their own email address and password; you must not share your login. You add someone by their account email, and they get Ultimate after they log in and accept. An account that already has its own paid plan, or is already on another Ultimate plan, cannot be added.
The people you add get Ultimate only while your Ultimate plan is active. They lose it, and move to the Free plan, if you remove them, if you change to a different plan, if you cancel and your paid month ends, if your payment is still missing after the 7 day grace period, if your payment is refunded, or if you delete your account. Their own websites and published sites stay in their accounts.
As the Ultimate owner, you are responsible for making sure the people you add follow these Terms. Each person added has their own daily website limit, but the 15 websites a month made with our most advanced AI model are shared by everyone on the plan (see clause 3).
17. Published sites, domains and forms
Publishing
You can publish a website at an address on Destiny using a site name you choose, as long as it is not already taken or reserved. Publishing is included on every plan, up to the number of live sites your plan allows. Sites published on the Free plan show a small “Made with Destiny” badge; paid plans do not. You can update a live site to a newer version or take it offline at any time. A site stays online while your account exists, unless it is taken offline under clause 12.
If your plan changes to one that allows fewer live sites, sites you already published stay online, but you cannot publish more until you are under the new limit.
Your own domain
On a paid plan, you can show a published site on a domain name you own, up to 2 domains per site. You must own the domain or have the owner’s permission to use it. You prove this by adding a DNS record we give you. You are responsible for buying and renewing the domain with your registrar and for its DNS settings. Domains are not bought through Destiny. A connected domain stops showing your site if you take the site offline, remove the domain or delete your account.
Contact forms
Forms on your published site send visitors’ messages to your account email. A booking form only sends a request for a date and time; it does not reserve anything, and you are responsible for confirming or declining it with the customer. You are the one collecting that information, so you must use it lawfully, reply to it responsibly and tell your visitors how you use their details. To prevent spam and abuse, each visitor can send a limited number of messages and each site a limited number per day.
Search engines
Published sites include the page title, a short description taken from the page, a preview for when the link is shared, and, on the home page, the business name, phone, email and address you gave us where they appear on the page, so search engines can understand the site. We never add reviews or ratings. We do not promise any position in search results.
Visitor numbers
We show you how many people visited your published site. Each person is counted once a day. Bots, search engines, link previews and your own visits while logged in are not counted. Only you can see these numbers. They are kept for 90 days and deleted when the site is taken offline.
